I went today but when I was ready to pay I told the lady’s that I want to pay with debit not credit but she mentioned about the extra charge if I pay with debit but I tried to explain that if I was paying with debit there was not charge but she insisted to charge me 3% for the transaction I even ask her about the sign and she point it there so I went and grabbed and same if I pay with credit card there will be a 3% charge for that transaction then with a black sharpie they cover where it said that if I paid with debit or cash there is not charge then I again explain to her that in California by law they can’t charge a fee if you pay with debit card she only repeat do you want it or pay with cash I don’t want the food to be wasted so I ask her to call her boss and she was mean telling him on the phone twisting the words but I didn’t complain because of course she didn’t know about this she just kept rolling her eyes on me and being very rude 2 ham tortas $20.00 1 Orange juice $8.50 1 chocolate muffin $3.08 1 mantecada $1.81 Tax: .82 Total $34.21 3% = $ 1.03 But for everything in total $35.24 This was the total charges then I asked why that much because on Monday I went and pay with cash and the bread was almost 3 dollars and it was the same bread then I asked why the lady to remove the bread and now the charge was 2 ham tortas $20.60 1 Orange juice $8.75 Tax .82c Total $30.17 she gave me back $.82c Because of the overcharge they use two different machines one is manual and the other one is a POS but with the manual they enter the extra charge on the small machine where they have to input the amount and on the computer it add everything automatically I paid and I have my receipt and I’m sorry but I will file a report. Federal law makes surcharge fees illegal on debit card transactions. That's even if the debit card payment is processed like a credit card transaction without requiring you to enter your pin. It is illegal to surcharge debit card transactions, as major card issuers like Visa and Mastercard prohibit it.
